Introduction

Kamerinspectie provides services on the basis of these terms of service. By using our services, you agree to these terms.

Kamerinspectie is a service of Label84, established in the Netherlands and registered with the Dutch Chamber of Commerce under number 88004279. Label84 is responsible for providing the services as described in these terms.

Definitions

In these terms of service:

• Services means all software, websites, APIs and related services offered by Kamerinspectie.
• User means any natural person or legal entity that uses the services.
• User data means the personal data provided by the user and processed through the services.
• Account means the user account that gives access to the services.
• Report means any inspection report, including photos, signatures and other data stored by the user.
• Report balance means prepaid or free usage units with which inspection reports can be finalised.

Use of the services

By creating an account and using our services, you agree to these terms of service. You may only use our services for legitimate purposes and in accordance with these terms. It is prohibited to use our services for any purpose that violates the law or the rights of third parties.

Users are responsible for all actions carried out under their account and API key. The API key must be kept confidential and must not be shared with unauthorised third parties.

Consent

By using our services, you consent to the collection, use and storage of your data as described in our privacy policy. Caching data obtained through our API is permitted as long as it is necessary to minimise repeated requests.

Availability

Kamerinspectie aims to make the services available 24/7, but does not guarantee this. We are not liable for any damage resulting from temporary or permanent interruptions, malfunctions or unavailability of the services, whatever the cause. Temporary unavailability does not justify a refund of subscription fees.

We reserve the right to change, suspend or discontinue the services in whole or in part, with or without prior notice, to the extent permitted by law. Continued use of the services after changes is considered acceptance of those changes.

Maintenance

Kamerinspectie may carry out periodic maintenance to ensure the performance, stability and security of the services. During planned maintenance, the services may be temporarily limited or unavailable.

We will make reasonable efforts to inform users in advance about planned maintenance that may significantly affect the availability of the services. Planned maintenance will mainly take place at night to minimise inconvenience for users.

In emergencies, including critical security issues or system failures, we reserve the right to carry out maintenance without prior notice. Kamerinspectie is not liable for damage resulting from planned or emergency maintenance.

Backups and data recovery

Kamerinspectie takes reasonable measures to prevent data loss, including making periodic backups. However, we do not guarantee that data can be fully recovered in all cases.

Users remain responsible for keeping copies of important reports and documents.

Report balance and payments

Some of our services are offered on the basis of report balance. To use certain services, you must purchase report balance in advance. Report balance is added to your account immediately after successful payment.

We reserve the right to change the prices of report balance. Price changes do not affect report balance already purchased and only apply to future purchases.

Report balance is personal and tied to the account, and cannot be transferred, sold or exchanged for cash, unless the law requires otherwise.

Report balance is valid for 2 years from the date of purchase. After this period, unused report balance expires without any right to a refund. When a report is finalised, the balance that expires first is used.

Purchased or partly used report balance is not refunded, unless there is a technical error or a situation in which we are legally required to provide a refund.

Right of withdrawal

If you purchase report balance or services as a consumer, you normally have a 14-day right of withdrawal. By explicitly agreeing to immediate delivery at checkout, you waive this right of withdrawal as soon as the service has been delivered or the report balance has been added to your account.

Termination of accounts

Kamerinspectie reserves the right to terminate accounts or restrict access to the services in the event of a breach of these terms of service, misuse of the services or at the request of the user. When an account is terminated, all unused report balance is cancelled and there is no right to a refund.

Termination by the user

You can terminate your account yourself at any time through your account settings. On termination, any unused report balance expires without any right to a refund, unless these terms provide otherwise elsewhere.

After the account is terminated, data remains available for export or recovery for up to 30 days. After that, the data is deleted in accordance with our privacy policy and the data processing agreement.

Data export

Users are responsible for exporting their data before terminating their account. Kamerinspectie will offer the option to export data for a reasonable period after the account is terminated.

Intellectual property

All intellectual property rights relating to the software, documentation, APIs and other services of Kamerinspectie belong to Label84 or its licensors. You may not copy, reproduce or distribute our services and products without our express written permission. All brand names and logos are the property of their respective owners.

Ownership of reports and user content

All reports, photos, signatures and other content that users store or generate through the services remain the property of the user concerned or their client.

Kamerinspectie only obtains the rights necessary to provide, secure, maintain and improve the services.

Liability

Kamerinspectie provides the services on a best-efforts basis. Except in the case of intent or deliberate recklessness, Kamerinspectie is not liable for indirect damage, consequential damage, lost profits, missed savings, loss of data or damage due to business interruption.

If Kamerinspectie is liable, its total liability is limited to the amount the user paid to Kamerinspectie in the twelve months before the event that caused the damage.

Nothing in these terms limits liability to the extent that such a limitation is not permitted under applicable law.

Force majeure

Kamerinspectie is not obliged to fulfil any obligation if prevented from doing so by force majeure. Force majeure includes in any case: failures at hosting providers, payment processors or other third parties on which Kamerinspectie depends, internet outages, power cuts, cyberattacks and other circumstances reasonably beyond the control of Kamerinspectie.

Misuse

Kamerinspectie reserves the right to temporarily or permanently restrict or terminate accounts or access to the services in the event of misuse. Users indemnify Kamerinspectie against all third-party claims related to misuse or breach of these terms.

Changes to the terms

We reserve the right to change these terms of service at any time. We will inform users in advance about material changes. Changes take effect when they are published on our website or on a later date stated.

Other provisions

If a provision of these terms of service is declared invalid or unenforceable, the other provisions remain in full force.

These terms of service are governed by and interpreted in accordance with the laws of the Netherlands. Any disputes arising from these terms will be submitted to the competent courts in the Netherlands.
